Description:
There are two recent developments involving the above referenced project that need Council attention.

At the northern limit on SR9, the Transportation Staff was approached by Lonnie Mimms of Mimms Enterprises, who recently purchased the shopping center in the northeast quadrant of the intersection, to consider access changes which would not hurt the economic viabilty of the shopping center.

After discussions, staff recommends asking GDOT to shorten the median proposed for SR9 to end 280 feet south of Commerce Parkway rather than at Commerce Parkway as currently designed. This will allow south bound cars the opportunity to make a left hand turn into the shopping center. We also discussed allowing a “U” turn at the end of the median at Holcomb Bridge Road

At the southern limit, the car wash owned by Mr. Sam Jones has been in dispute for months. Federal guidelines mandated a “Cost to Cure” be developed as a basis for negotiations regarding real estate and business impacts to the site related to the intersection improvement. The position of the parties was vastly different and were not making progress reaching agreement for a variety of reasons.

Recently, our senior staff met on site with the owners and designers to attempt to resolve some of the issues. During this meeting the property owner requested his property be dropped from the project. Initial inquiries to GDOT indicated this is a feasible alternative but we will need to modify the plans accordingly.

This development is encouraging for a number of reasons. First, it leaves the car wash whole, which is what the property owner desires. Second, it saves the City a great deal of money. Third, it allows us to correct the sight distance issue on Clara Drive outside of the Federal guidelines, making the process much less restrictive...
