Item Summary:
The applicant has filed a sidewalk cafe application to operate a sidewalk cafe in front of I.N.C. Street Food. Sidewalk cafe licenses are granted by the Mayor and City Council. The applicant has proposed two phases of work. The scope of work proposed for Phase I includes the installation of posts and chain on top of the existing stone retaining wall. This work would be completed immediately following the approval of the sidewalk cafe license. The scope of Phase II includes the removal of the stone wall. The applicant proposes to complete this work upon receipt of required permits.
The applicant completed all the special requirements set forth in the license application and received approval for Phase I of the application on March 8, 2010. The application was approved with the following conditions:
1. Phase I is approved with two tables.
2. The posts and chain must be located in front of your building and may not encroach into the sidewalk area of the adjacent property.
3. The plan for Phase II must be submitted to the HPC for approval.
The applicant requests HPC approval of Phase II of the project.
Staff Recommendation:
Staff recommends approval with the following condition:
1. Due to the height of the wall and ADA requirements, a simple, metal railing should be installed in place of the proposed post and chain barrier.
