Title
RBZA11-06, Larry Davenport, 963 Canton St.
Body
Item Summary:
The applicant is requesting a variance to the Zoning Ordinance regarding minimum lot coverage. They are requesting an increase from the maximum of 60% required in the C-1 district to allow 86.5%.
Staff Report:
According to Table 6.2 'Dimensional Requirements for Office and Commercial Zoning Districts', of the Roswell Zoning Code, The maximum lot coverage permitted in the C-1 zoning district is 60%. The building at 963 Canton Street currently covers 86.5% of the lot. The property owner built a rear addition with deck in 2011. The addition was permitted through the City of Roswell and approved by the Historic Preservation Commission. Planning staff failed to identify the lot coverage issue during the HPC process or permitting. It was not until after the addition had been permitted and built that staff noticed their error. Staff reviewed the issue with the City of Roswell Legal Department who advised them that the best course of action would be to pursue a variance to the lot coverage requirements through the Board of Zoning Appeals. Prior to the new addition, the lot was already at 78% coverage; over the allowed 60%. They are seeking a variance from Table 6.2 to allow for 86.5% lot coverage to accommodate the current lot coverage with the rear addition.
Due to the circumstances of this case, City of Roswell Planning and Zoning staff has taken the lead in pursuing this variance on behalf of the applicant.
