Item Summary:
On February 4, 2011, Pastis submitted an application for a license to operate a sidewalk cafe in front of 928 Canton Street. The application included a proposal for two phases of work. Phase I was for the installation of five tables and ten chairs along Canton Street. Mayor and Council approved this request on March 14, 2011. Phase II of the application included filling in three and half on-street parking spaces in order to extend the sidewalk to allow for a larger outdoor dining area. Mayor and Council approved the request to fill in only three spaces leaving two spaces open on May 9, 2011. This approval included the condition that if the construction was not finished within six months that the approval for the sidewalk extension would be null and void. The restaurant owner did not do the work within this time frame and has resubmitted the application. The resubmitted application and Staff recommendation comply with the previous approval.
The current application is for a license to expand the existing sidewalk café by filling in three parking spaces located on Canton Street, directly in front of Pastis restaurant. This work would be completed at the applicant's expense. If granted, the number of tables and chairs will increase from five tables and ten chairs to fourteen tables and twenty-eight chairs. The scope also includes a post and chain barrier and umbrellas. This proposal provides the five foot clear distance required by Article 10.39.5. The furniture specifications provided comply with the pre-approved furniture list included in the sidewalk cafe application.

The staff has reviewed the application for 928 Canton Street and deems it complete and recommends approval with the following conditions:
