Title
HPC11-39, 1132 Canton St., Slate Table & Tap, Brian S. Martin
Body
Item Summary:
Applicant is asking for a Certificate of Appropriateness for the addition of a seasonal vinyl/canvas rear patio enclosure to the restaurant.
Staff Report:
Background
The structure located at 1132 Canton Street is classified as "Historic" on the Historic Properties Map adopted by the Mayor and City Council in April of 2003 and was constructed in 1947 according to the Fulton County Tax Digest.
The Historic Preservation Commission approved an application for the rear patio at their meeting on November 10, 2010. The request was approved with the following conditions:
1. If required by alcohol beverage license requirements, the patio enclosure should be of a minimal profile darker fencing or landscaping. The fence specification should be submitted to the Architectural Review Committee for final approval.
Following the meeting, it was determined that an enclosure would be required to comply with the Alcoholic Beverage Ordinance. This requirement will also be in effect for the new restaurant.
On September 14, 2011, the HPC approved the addition of a roof for the rear patio. The application was approved with the following conditions:
1. Final architectural drawings to indicate the translucent panels on the back roof shall be presented to the architectural subcommittee for approval.
2. The structure surrounding the extended porch area shall be open as shown on the right elevation, without any siding. It will have both a horizontal member and an angle member.
3. The patio area on the front of the building shall have fencing. That fencing was discussed on the previous application of using some type of chain and post. Richard Hallberg stated that is already approved by city code.
A revision to a previous condition of the patio roof approval, related to the roof material, was approved by the HPC on November 9, 2011. The application was approved with the following condition:
1. The end cap scrolls are re-looked at and submitted to staff for final approval.
Proposal
The applicant's request is for the addition of clear café curtains to enclose the dining area under the rear patio roof. The curtains will be clear vinyl with a "Sunbrella" canvas border.
Zoning
H-R (Historic Roswell) / OP (Office Professional)
North: H-R/O-P (Historic Roswell/Office Professional)

Staff Recommendation
The staff recommends approval of this application since the curtains are removable and the addition of the curtains will not result in increased dining area square footage. Staff recommends approval with the following conditions:
1. The vinyl must be maintained in good condition.
2. The curtains must be contained within the porch footprint and may not be extended to enclose stairs, or any sidewalk areas without HPC approval.
3. As long as there are no changes in the appearance of the curtains, they may be reinstalled annually from November 1st-March 1st.
4. The applicant must consult with the Chief Building Inspector and Fire Marshal to insure that the installation of the curtains complies with all Building and Fire Codes.
