Item Summary:
On March 23, 2012, Kathryn V. Logan requested that the City cedes to her the portion of the Elizabeth Lane right-of-way that fronts the last four parcels at the eastern end of the street.  Two of these parcels - 296 Junction Tract, on the north side, and the one on the south side belong to the Logans who would like to build a shop with a septic tank on the southern parcel.  Fulton County requires a full acre for septic which the road abandonment will provide.
 
Staff agrees to this request for the following reasons:
     a.      The Department no longer uses or plans to use that property.
      b.      Abandoning this property will reduce the City's street maintenance costs and liability.
     c.      The other two adjacent homeowners do not object to the abandonment nor wish to receive any portion of that right of way.
     d.      The Logans have submitted a survey (abandonment plat) of the property showing property being abandoned along with legal descriptions, as required.
Committee or Staff Recommendation:
On August 29, 2012 the Community Development and Transportation Committee recommended placing this Item on the September 12, 2012 Mayor and Council Agenda.
