Description:
· The storms in September 2009 caused severe erosion in the emergency spillway and along the sewer pipe at the watershed dam at Brookfield West. The sewer line is currently exposed and creates a serious safety and health hazard. The responsibility lies with the Fulton County Soil & Water Conservation District (FCSWCD) to make the repairs back to pre-storm conditions. The Georgia Soil and Water Conservation Commission (GSWCC) and the Natural Resource Conservation Service (NRCS) have partnered to assist the FCSWCD to make the repairs and have made funding available through the federal Emergency Watershed Program monies. However, they need to partner with another public entity, such as the City, to assist them as a contracting agent. They have approached the City to act as the contracting agent for this project.
· A meeting was held with agency reps, City staff and legal counsel to discuss the options. Items for consideration: 1) The City can legally enter into an agreement with the District, provided the agreement states that it is on an emergency basis; and 2) that the District retains ownership of, and ongoing maintenance responsibility for, the dam and easement. No outlay of funds is required by the City of Roswell.
· The estimated cost of repairs is $139,000. The NRCS staff will complete the design plans and the construction will be procured and implemented by the City of Roswell, with design oversight by NRCS. Invoices for work would be approved by the City of Roswell and submitted to the FCSWCD and then forwarded to the GSWCC for payment to contractors. The benefits of repairing the spillway to pre-storm conditions is for flood protection. The work is required to be completed by September 30, 2010....
