Item Summary:
The construction contract for the SR9/SR120 Intersection Improvement project has been awarded and the contractor is scheduled to begin as soon as this issue is resolved. As part of this project, three power poles need to be relocated. Georgia Power has conducted an in-house prior rights research and found that they have "prior rights" at the locations in question.  Georgia Power has informed the City that due to prior rights they will be seeking a reimbursement of $32,197.
 
Transportation staff worked with Legal to determine that Georgia Power poles within State right-of-way do not fall under the City's franchise agreement.

On February 28, 2012 the Community Development and Transportation Committee recommended placing this Item on the next appropriate Mayor and Council Agenda.
 
Financial Impact:
Upon approval of budget amendment BA 35042200-04-09-12, funds in the amount of $32,197 will be will be transferred from the available funds in the Midtown Streetscape account, ORG: 350442200, OBJ: 541415, Project: 90002 to the SR9/120 Intersection Improvement Project account, ORG 35042200, OBJ 541415, Project 91006.  $158,257.70 will be remaining the Midtown Streetscape project account.
