Item Summary:
The original contractor for the Midtown Gap Sidewalk Project was terminated for default in mid-September, 2013 by the City of Roswell due to non-performance.  American Contractors Indemnity Company, the surety bond company for this project, was contacted to remedy the default and complete or procure the remainder of work on the project.  They conducted a bid process and determined Woodwind Construction Company, Inc. to be the most responsive, responsible contractor to complete the remainder of the unfinished work in the amount of $89,030.
 
Woodwind's bid adds extra cost of $27,017.60 to complete the remainder of the project for which the surety will pay. This new contract with Woodwind Construction Company in the amount of $89,030 will complete the remainder of the work.  Contract performance period is 50 days from notice to proceed.  
 
Due to the nature of the project, the final cost will not be known until all of the work is completed satisfactorily.  Credits may be due to either Roswell or the surety as specified in the tender agreement.

On November 25, 2013, this item was discussed at the Community Development and Transportation Committee meeting.
Financial Impact:
Upon approval of the Woodwind Construction Company, Inc. contract, $37,108.40 will be remaining in Project 92010, Organizational Unit 35042200 and Object 541415.
